BBM EV Rentals — Rental Terms & Conditions

These Rental Terms & Conditions ("Terms") govern the use and rental of vehicles offered by BBM PVT LTD ("BBM", "BBM EV Rentals", "we", "our", or "us") through the BBM Rider application, website and related services. By creating a booking and renting a BBM vehicle, you ("Rider") agree to these Terms.

1. Rider Eligibility

A Rider must: be at least 18 years old; have an active BBM Rider account; complete required mobile-number verification; complete required identity/KYC verification; provide accurate information; and meet requirements applicable to the vehicle being rented. BBM may use DigiLocker and authorised verification providers to perform identity verification. A selfie/liveness check may also be required.

Driving Licence

Where a BBM vehicle falls within a category that does not require registration or a driving licence under applicable Indian requirements, BBM may permit eligible users to rent it without a driving licence. Where the vehicle's specifications or applicable law require registration and/or a driving licence, the Rider must possess the required valid licence before renting that vehicle. Vehicle eligibility must always follow the actual specifications of the vehicle and applicable law.

2. Booking and Rental Plans

BBM may provide rental plans including daily, weekly, 15-day and monthly. Available plans, rental periods, kilometre/usage limits where applicable, prices, deposits and other charges will be displayed before booking. Prices may vary by vehicle, location, duration, availability or plan.

3. Security Deposit

BBM may collect a refundable security deposit when a vehicle is booked. After the vehicle is returned, BBM may inspect it before releasing the deposit. Permitted deductions may include applicable amounts for: vehicle damage attributable to the Rider; missing equipment/accessories; outstanding rental charges; late-return charges; excess usage; applicable fines; unauthorised use; and other amounts lawfully payable under the rental agreement. The remaining refundable amount will be returned through the applicable payment method.

4. Payments

Payments may be processed through Razorpay or another authorised payment provider. The Rider is responsible for applicable: rental charges, security deposit, extension charges, late fees, damage charges, excess usage charges, and other charges clearly disclosed under the applicable rental plan.

5. Vehicle Use

The Rider must: operate the vehicle responsibly; follow applicable traffic and road-safety laws; use appropriate safety equipment; keep the vehicle reasonably secure; follow the applicable operating/geofence restrictions; and return the vehicle according to the booking conditions.

The Rider must not: sub-rent or transfer the vehicle; permit unauthorised use; race the vehicle; intentionally overload it; use it for unlawful activities; intentionally damage it; tamper with GPS or telematics equipment; disable security systems; remove BBM equipment; or circumvent geofence controls.

The Rider remains responsible for the vehicle during the rental period subject to applicable law and these Terms.

6. GPS Tracking and Geofencing

BBM vehicles may contain GPS/telematics devices. Vehicle location may be tracked during active rentals for: safety, fleet management, theft prevention, vehicle recovery, geofence enforcement, and investigation of misuse. The Rider must not intentionally remove, damage or interfere with the tracking equipment.

7. Remote Vehicle Immobilisation

Where supported by the vehicle/telematics system and permitted by law, BBM may remotely restrict or immobilise a vehicle in situations including: reported or suspected theft; failure to return the vehicle; serious unauthorised use; applicable overdue-payment/default situations; material geofence violations; and other serious breaches requiring vehicle recovery. BBM will not intentionally initiate immobilisation while the vehicle is moving where doing so could create a safety risk.

8. Vehicle Return

The vehicle must be returned: at the required time; at the designated BBM location/hub or otherwise as instructed; in reasonably acceptable condition; and with provided accessories/equipment. The Rider should report any damage or issue identified during the rental.

9. Extensions and Late Returns

Rental extensions depend on vehicle availability and applicable payment. The Rider should request an extension before the existing rental period expires. Late returns may result in additional charges displayed or otherwise disclosed by BBM. Continued unauthorised possession of a vehicle may result in account suspension and vehicle-recovery action.

10. Accidents, Damage and Theft

The Rider must immediately notify BBM of: accidents, vehicle damage, theft, attempted theft, loss of vehicle, serious mechanical problems, and other incidents affecting vehicle safety. Where appropriate, the Rider must cooperate with BBM, insurers and lawful authorities. The Rider may be responsible for damage or loss resulting from misuse, negligence, unauthorised use or material breach of these Terms, subject to applicable law.

11. Insurance

Insurance coverage, exclusions, deductibles and claim procedures depend on the insurance applicable to the relevant BBM vehicle. Exact BBM vehicle insurance terms: [TO FILL from insurance policy]. Nothing in these Terms should be interpreted as providing insurance coverage beyond the actual applicable insurance policy.

12. Cancellation and Refunds

Bookings may be cancelled according to BBM's cancellation policy displayed during booking. Final cancellation window and charges: [TO FILL]. 13. Fines and Violations

The Rider is responsible for fines, penalties or charges attributable to the Rider's unlawful or unauthorised use of the vehicle during the rental period, to the extent permitted by law.

14. Account Suspension

BBM may suspend or terminate access where reasonably necessary because of: fraud; false KYC information; non-payment; vehicle theft or attempted theft; unsafe use; unlawful activity; GPS/telematics tampering; repeated violations; or serious breach of these Terms. Where appropriate, BBM may take lawful steps to recover its vehicle.

15. Service Availability

Vehicle availability is not guaranteed. Bookings or services may be affected by maintenance, technical failures, accidents, network problems, payment-system interruptions or other circumstances. BBM may temporarily remove unsafe or unavailable vehicles from service.

16. Limitation and Responsibility

Nothing in these Terms excludes liability that cannot legally be excluded. The Rider remains responsible for losses or charges properly attributable to misuse, negligence or breach of these Terms, subject to applicable law, insurance and the final liability policy adopted by BBM.

17. Privacy

Personal information is handled according to the BBM EV Rentals Privacy Policy. Use of GPS, KYC, identity verification and other personal information is described in that policy.

18. Changes to Terms

BBM may update these Terms where necessary because of changes in services, pricing, technology, operations or applicable requirements. Material changes may be communicated through the application or website.

19. Governing Law and Jurisdiction

These Terms are governed by applicable laws of India. Subject to applicable consumer and other laws, disputes will be subject to the jurisdiction of the competent courts at: [TO FILL — City, State].
